Another One Of My Questions.

Say I was wondering through the Vineyards and saw a Picture of Barrels on the Vinyards property.

I saw a Pic to be taken, I turned it into something pretty good and sold it.

I also asked the property owner if I could take Pics and he said yes, I didn't say what for.

Is this ok even though it is their property ?

i suppose you should have had a form signed before selling the image.

The way I see it - you own the copyright on the photo and can do what you like with it. But, in saying that, I would also acknowledge the property and owner, if published. I reckon anyone would be stoked to get FREE advertising :wink:

I'm no lawyer, but my understanding is that unless access to the property was granted under conditions which included limitations on what you could do, then you can do whatever you like with the photo's. You own the copyright to the images, regardless of where they were taken.

Now, if there were conditions attached to the entry (as there usually is these days at, for example, major sporting events) then those conditions would state what can or can't be done.

As Chris says, an acknowledgement would be nice, but even that is probably not required.

If, on the other hand, you were going to use the image in promoting a commercial endevour (ie: in an advertisement rather than simply selling as 'art'), and the image clearly identified a person, then a model release would certainly be required. Not sure about identifying another company though.
