I am certainly not opposed to people/orgs using my images, especially if they ask nicely (or offer beer), however its kinda irritating when ..errm large orgs just take and use a image as they please.

Now note, this image is posted on their gallery page by myself and I am pretty sure their terms (whilst I cannot find or check their Terms/conditions

) would say they can bend me and my picture over at any time of the morning, its still rather rude not to even drop me a email (even just to check my name is right

)

So..keep a eye on where you post your images.. you will never know where they end up, you can guess my surprise when a colleague found one of my images whilst reading a reputable flight rag and the only reason it got picked up is cause its also hanging in our office

You think they could at least add a by line for it.

I was alerted to one of my car photos being used in an online ad for car parts.
In my case they just ripped it off the web and used it. I hadn't posted it anywhere that allowed them to use it.

That is when you send them a DMCA....not sure if it is only applicable with the Americans though

Send them a bill for $600. Inform then that is your usual charge for a one time use of your image. Also offer them full ownership of the copyright for a further $3500. Thank them for choosing your artwork to use in their publication.

What publication was it as the journalist who wrote the article is in London.

yeah boring as batshit, i think they were struggling for page coverage, obviously had no images of skywest in their user galleries.. :roll:

remove my images from the site and write a polite email about how I am disappointed about not getting even a email, you know if they had even simply emailed me and said 'hey we wanna use your image is that cool?' i most likely would said 'yeah sure bro..sweet as.. just put my full name there' (rather than the handle for the gallery)....

As a policy we always credit the photographer when we use their image and link to their gallery on AirSpace. Unfortunately we cannot pay for every image used but we endeavour to run a number of competitions throughout the year where cash prizes are given out to the best images. If anyone has an issue with their images being used, please feel free to email me.

So how specifically are your images used:

In the print magazines: Flight International, Airline Business and the air show daily operations FDN and FEN.
On the website: on Flightglobal homepage and various articles, blog posts or slot advertisements.
AirSpace image of the week: A weekly competition where the image of the week, which is chosen by Flightglobal editors’, features on both Flight International (on page 3) and on Flight’s Image of the Day blog.
Flight International front cover competition: A chance for the best image from AirSpace to feature on the front cover of Flight International’s end of year edition.
AirSpace calendar competition: A year long competition where the best twelve images from AirSpace feature in a calendar which is sold on Flightglobal’s shop(you can pre-order a copy of 2010's calendar now)

Sorry Gerry, apart from not receiving an email that they were going to use the image (not sure one should expect polite correspondence from big organisations), I am not sure what the issue is, particularly in light of your original post.

You indicated they gave you credit via your 'handle', which I assume is something like biggerry, and the T&C state where and how they can use the image. The thread title and opening post suggest that something sinister has occurred when in fact they did what you should have expected they may do.

Flight global are just running a great gig here for getting free images for their publications. I can only see pro photogs loosing out here although one could argue that stock pictures are not that expensive these days. So I guess the winner is Flight Global in the end. Perhaps the amateurs will get some 'credit' although I doubt anything could come out of it.

Perhaps one approach on your part could be to plaster a great big watermark on your pictures if you don't want them to copy it. I assume it's nice for you to mingle with the aerospace crowd here so no need for you to withdraw your images. Just make sure your watermarks are at least 70% of the image.

Am I allowed to change tack just a tad? I think this post fits this topic. (If not, I can move it elsewhere)

I have a registered business name in NSW. A rather large NSW company, which spends massive amounts on TV advertising throughout the day, is using my business name in it's ads. Is this permissable? If not, what steps should I take to stop them doing so?

Any advice from the legal sages appreciated.

My only advice is to speak with a legal sage (not sure if there are any here). I don't recommend taking legal advice from photographers as you don't take photographic advice from lawyers

Thanks Patrick. That's along the lines of what I was thinking, but not having funds for a lawyer, I'll see how things go. I'm certainly not losing any sleep over the matter.

As far as the original photo/post from Gerry goes, yes, it does happen all the time, unfortunately.

Hey Patrick, I was not intending to promote anything sinister nor really identifying any specific issue, more a simply just posting awareness (and my experience) that one should be wary of where one uploads images.

I personally think that if one is to use a image the very least they should get a proper credit line, not some handle - I actually think this more from a professional point of view for the mag, having a proper name rather than some obscure or strange handle would be much more appropriate (i may change my handle to 'flying boobs' just for kicks and giggles)

exactly, win win for them - plenty of amateurs out there happy to upload their images.
