I know that this topic has been discussed many times, but this is a very clear legal perspective on the debate.
The following article by Andrew Nemeth LLB, is a detailed analysis of the legal issues surrounding street photography in NSW Australia.
Originally created in response to objections to my Sydney Unposed photo project, it's written from a photographer's perspective, and the emphasis is on what rights shooters have (and don't have) when it comes to candid photographs of people.

Great article, very detailed and informative. Perhaps anyone doing street, beach or just any public place photography should carry the summary with them in their bag at all times...you never know.

Great link Mal.
I wonder how QLD differs from NSW? I would assume basic concepts like copyright, public vs private place etc would be the same.
Anyway, it gives us a bit of ammunition if we decide to stand our ground when confronted by a rent a cop or other in a public place.

I too did what everyone else did above.
I also added my name to the Aust Law Reform Council public list for info and releases on the changes to the Privacy Act 1988. The link was near the end in the article.

Good read. Its a right, to photograph candids of strangers, but also cautious with regards to abusing that right. Well balanced article.
