From your comments, AAMI are going to pay you the $3000 first up?

And then if they manage to get anything more out of the other party. (How much was the car insured for?) They will forward this to you as well.

Seems an odd way for them to run the situation, I thought. Doesn't AAMI still have that policy in place that if you can identify the other party you are not in fault at all and the claim should be paid 100% straight away?

I'm only insured for 3rd party property and I don't get this sort of benefits. Their policy is up to $3000 uninsured motorist claim.

What a bugger.

If you see a Nissan Skyline, or Subaru WRX, then there's a 99% chance the driver is a reckless idiot hoon.
These two vehicles are, by and large, the hoons car of choice these days.

Back in my day, it was a 308 HQ with factory fitted fuzzy dice, or an 351 XC Falcon that didn't have the brakes to match the engine.

Hope it gets sorted soon, and the driver is charged with serious traffic offences... but what a P.I.T.A. for you in the meantime.

This is the sort of issue that always comes up with people and statistical generalisations! 99% chance huh? Must be in your area then I'd say because it is no where near as bad in my area. Just like any vehicle on the road there are the good drivers and the bad, the WRX and Skyline models just get more coverage than other vehicles. The VX, VY commodores and BA falcons are just as popular today with the younger generation as the HQ / XC were back when I was a teenager, they just don't get the same media coverage and don't stand out like the Japanese models do.

Perhaps most people I know with a WRX must be part of that 1% then, and I know quite a few people with one, and actually own one as well, in which my wife drivers around most of the time, and while she will have a squirt now and then she is far from a reckless idiot hoon...

Granted the guy that rear ended Yi-p's car was reckless and driving like an idiot, but don't paint the majority of drivers with that brush (just some of them if you please). And yes I hope the driver has the book thrown at them in a big way, perhaps it will help to bring the insurance premiums down a tad!

Thank you, I rest my case.
Cars like these are only bought for one purpose - to have a "squirt".

Yes, you must be in that 1%, because 99% of the time I see a WRX or Skyline, it's a young male driver who seems to be in hurry to get somewhere quick, with lots of squirting going on. Most of these fools think they are on a racetrack, and not a public road.

In the case of my wife a squirt entails going up to the speed limit and not beyond when on a major arterial road. We have a 21/2 year old son, you think she is stupid enough to do it anywhere else?

But while I do agree there are a certain element out there that do drive recklessly without thought of where they are or who might just wander into their path these are not in the majority. Perhaps you have the 'younger' (said with tongue firmly planted in cheek) element in your area who are more prone to this sort of thing. We have a few young WRX drivers in our suburb but they are always driving in a safe manner around the neighbourhood, and owning one I know what they sound like when they are driven recklessly. The other thing is that the normal car does not exhibit the same head turning ability that a WRX or Skyline will when given a squirt, this means that when the same sort of people in their Camry or Excel, Civic etc do the same thing it is not as noticeable so they aren't labeled as hoons!

I'm sorry you have a bad experience with WRX and Skyline owners, I can say they are in the minority and I can also say they should not drive like that in suburbia, but unfortunately it is not the car that does it, it is the idiot behind the wheel. Give them a Proton, or Hyundai and they'll do the same thing, and even though they may not get to the speed the WRX or Skyline does, they are still more than enough to severely injure or kill someone.

As an example in the 9 years of owning the WRX (from new) it has been involved in one accident where the other driver ran a red light, it has incurred one speeding ticket, my own fault for being impatient (I guess that will help you further rest your case). It has driven over 170,000 km with only 6,000km put on it in the last 24 months. Other than that it has not been in any close calls, not been complained about to the Police, not had warnings issued against it and not upset any of our neighbours etc. My wife (the now labeled hoon, has been driving it for the last 7 years) and she has clocked up no speeding fines or accidents in it.

Anyway in all seriousness we've taken away from Yi-p and his horrid predicament, I'll not comment further, I just really don't like generalisations like that thrown around when I am to be included in such a generalisation. In this case the WRX driver could well be a knob and should be prosecuted to the full extent of the law if he was driving in a stupid and reckless manner...

Apologies for the lengthy post.

[edit] PS. I'm not having a go at you either Adam :) Just so you realise.

That sucks to hear about your misfortune Yip. Hope you get some cash sorted to tide you over in the short term and dont be afraid to sue this bastard in the civil courts. From the sounds of it - he deserves it. All the best and I hope you get some good luck soon!

Hi, Can you give me an update of the situation
I have an exactly the same situation and my insurner is AAMI as well... our rear end of the car is similar to yours one...
Our fixing cost is $7000, AAMI now refuses to pay us $3000 based on the reason that the other driver has agreed to pay us the $4000 difference. I am very interested to heard did you get the $3000 from AAMI. We did not even get a single penny from other driver yet !!
