Is this too good to be true?

Postby Regdor on Fri May 20, 2005 3:51 pm

http://www.esmartsoftware.net/adobe.php

I found this site when searching for Photoshop CS2.

When I asked about registration ,they said it was done through their site.

I thought PS could only be registered by contacting Adobe.

Do I smell pirates???

Rodger.

Aye Aye Matey!

If it's too good to be true it usually is.

this is their last line in their FAQs:

11.) Isn't this considered software piracy? Absolutely NOT. We are providing a service protected under US Copyright law Section 117. This is completely legal and in no way are we breaking any Copyright laws.

9.1 You understand that in order for eSmartsoftware.net to make you a copy of any software, you acknowledge that you are the legal owner of this same software, and are looking to just make a new copy for archival (backup) purposes only.

Arrrrr me hearties!

A legal precedent, I believe, has been upheld in a US court that if you wish to GIVE your software to anyone it is not considered illegal to do so.

I bought the whole Adobe Creative Suite for A$568 last Sunday at Harris Technology (sorry Leigh )...

It was the "Education" version and all I had to do was prove that my daughter was attending a school... It also works if you or anyone in your household is a student I believe...

Their "Education" price for Photoshop is A$431...

I couldn't help myself :) - taken from live chat with these guys

me: How exactly can you justify selling this legally ? * see http://photoshopnews.com/2005/05/16/if- ... e-it-isnt/

You are now speaking with Steve Eagon of Sales.

Steve Eagon: Hello sir. can you share that link again ?

me: http://photoshopnews.com/2005/05/16/if- ... e-it-isnt/

me: this is a question - not an accusation. I am intrigued re your software prices being so low

Steve Eagon: have you familiarized yourself with our terms of service

me: I have

me: On your homepage you advertise 'eSmartsoftware.net is a web site that sells full version PC - Windows software only!
'

Steve Eagon: we do not claim to offer brand new factory sealed software

me: Infact you sell backup binary files of full versions

Steve Eagon: true. fully functional exhisting copies of data for liscenced users

me: That is not a full version of software. A full version includes a license

Steve Eagon: then perhaps you should consider purchasing your software somewhere else

me: As I cannot purchase my software from you legally I shall - I wanted to confirm that indeed you do not sell licensed software as your homepage represents you do.

me: thankyou for your time

Will be interesting to see how many 100% money back garuntees they honor when people dont read the terms of service (eg when was the last time you read a full software purchase terms of service LOL)

I have an idea lets start up a 'share your educational license resource' thread here. My wife qualifies - whomever can trace their family tree to a Wheadon/Green/Hall or Hocking can then take advantage of our educational pricing and I'll hand deliver to you as well with a smile AND a license key LOL
